1. You agree that by “I Agree” below you are electing to use an optional service and providing us with written instructions to procure a background check or ID check on you (through our engagement with Vendor, as defined below) to determine your eligibility to receive a “Background Check Icon”, where listers or movers have required such a badge in order to rent to or share a space with you. This background check will include a search for criminal records that may be linked to you in the offense categories of Sex, Violence, Theft, Substance Abuse, Fraud, Property, Terrorist Watchlist, and Registered Sex Offender. For a complete list of the kinds of offenses checked by Vendor please see below. If you undergo a background check and such check does not identify any records in the specified categories comprising the background check, as determined by Vendor in its sole discretion, you will receive a Background Check Icon on your profile.
2. Chillow uses a third-party vendor called EvidentID (“Vendor”) to run background checks on your behalf when instructed by you. Chillow does not require you to obtain a background check in order to use our services, nor do we participate in any way the processing or evaluation of the background check.
3. Vendor may obtain information about you from a consumer reporting agency in order to run the background check. Thus, you may be the subject of a “consumer report.” The consumer report may contain information regarding your criminal history and/or motor vehicle records, and may also contain other background information about you. You have the right to request from Vendor and inquire into whether or not a consumer report was in fact run on you, and, if so, you have the right to request the contact information of the consumer reporting agency who furnished the consumer report to Vendor.
4. Background checks can be helpful and uncover potential red flags, but it's important to understand that background checks are not always accurate and may not reveal a person's complete criminal history or suitability as a roommate. There are significant gaps in the coverage provided by these checks. For example, not all local jurisdictions or states report comprehensively into these registries or the national criminal database. Vendor does not search records pertaining to every courthouse, or even every county. Vendor also does not pull information and records from international databases. We therefore strongly recommend that a background check only be used as one part of a roommate selection and evaluation process. A background check is not a substitute for in-person and telephone interviews, meetings, reference checks, online and social media searches, or obtaining copies of identification documents, regarding any potential roommate. For your information, Vendor checks the National Criminal Database, Sex Offender Registries, and Global Terrorist Watchlists. 5. Chillow may have access to the results of your background check, but in general while we reserve the right to review results, we do not typically review results manually. Instead, if such check does not identify any records in the specified categories comprising the background check, as determined by Vendor in its sole discretion, our systems will automatically send this result to your profile, by appending a Background Check Icon, without further action on our part.
6. Chillow does not share the actual complete results of your background check with other Chillow members.
7. Chillow simply publishes a Background Check Icon that a background check did not reveal you had a record in any of the specified categories comprising the background check only for movers or listers who authorized and Vendor did not identify any prior records in any of the specified categories as a result of the background check.
8. If you request and such check identifies a record in the specified categories comprising the background check, as determined by Vendor in its sole discretion, your profile will not display the Background Check Icon. Other Chillow users will not know whether or not you used the third-party background check service.
9. YOU ACKNOWLEDGE AND AGREE THAT THE BACKGROUND CHECK SERVICE IS BEING PROVIDED BY A THIRD-PARTY AND NOT BY CHILLOW. BY ELECTING TO USE THE BACKGROUND CHECK SERVICE, YOU HEREBY AGREE TO RELEASE AND FOREVER DISCHARGE CHILLOW AND EACH OF ITS AFFILIATES FROM ANY AND ALL LIABILITIES, CLAIMS, ACTIONS, DAMAGES, COSTS OR EXPENSES OF ANY NATURE WHATSOEVER, WHETHER IN LAW OR EQUITY, KNOWN OR UNKNOWN, THAT YOU MAY EVER HAD, NOW HAS OR HEREAFTER CAN, SHALL OR MAY HAVE AGAINST CHILLOW AND/OR EACH OF ITS AFFILIATES ARISING OUT OF OR IN ANY WAY RELATED TO THE BACKGROUND CHECK, INCLUDING THE THIRD-PARTY VENDOR’S COLLECTION, USE AND VERIFICATION OF YOUR INFORMATION AND THE RESULTS OF THE BACKGROUND CHECK.Offenses Checked:
